Florida Group Health Insurance
Under Florida Statute, group health insurance for small business in Florida is defined as any employer that employs between 1 and 50 employees. Benefits under group health insurance plans in Florida are similar to benefits under an individual health insurance plan with some minor but very important exceptions.
Some of these exceptions include
- Guaranteed Issue Health Insurance: Any employer that has between 1 and 50 employees and applies for a Florida group health insurance plan cannot be turned down for any reason related to pre-existing conditions. Insurance companies are permitted to ask general gatekeeper type health questions, but can only use the information obtained in determining the final rates. They are permitted to increase or decrease the standard rate by 15 percent.
- Mandated Benefits: Group health insurance policies in Florida are required by law to include certain types of benefits including maternity, and mental illness.
- Pre-Existing Conditions: Conditions that are considered pre-existing are covered under Florida group health insurance provided certain conditions are met. If an employee has had continuous qualifying coverage for 12 months without a gap of 63 days or more than pre-existing conditions would be fully covered. If continuous coverage is less than 12 months than credit is given for the total number of months the person was covered then subtracted from 12 months. The remaining number of months would apply to any pre existing condition. A pre-existing condition is defined as any condition regardless of the cause of the condition, for which medical advice, diagnosis, care, or treatment was recommended or received within the 6-month period ending on the enrollment date. In the state of Florida maternity is not considered a pre-existing condition.
